Recent heated debate over Blasphemy laws is getting worse day by day and now the issue has gone to the level of insanity and now people are using it to score political points.
The issue got worse when instead of taking the issue in parliament or Islamic ideological council , the issue is politicized for point scoring left/right politics or liberal/mullah politics. Now its high time for religious scholars, law experts and human rights experts to sit together and resolve the issue by doing a constructive legal and academic debate. We have a very basic principle in Quran :
“O ye who believe! Be steadfast witnesses for Allah in equity, and let not hatred of any people seduce you that ye deal not justly. Deal justly, that is nearer to your duty. Observe your duty to Allah. Lo! Allah is Informed of what ye do.” [Al-maeda ,8]
The biggest blasphemy that can be done is to introduce things in the name of Allah and Prophet (S.A.W) which are not part of their teachings.
We need to improve Qazaf laws for false witness, law of witness itself, importance of personal testimony, procedure of implementation and also we need to see whether this law can be implemented on minorities or not. According to fiqh Hanafi the dominating fiqh , the law cannot be implemented on Zimmi or non muslims under the responsibility of an Islamic State. Even for majority muslim population we need to see what punishment is there according to Quran and Sunnah or social circumstances of the alleged person should be considered during the case like the punishment for Zina or adultery committed by muslim with backward or uneducated social background is half as compared to other muslims and also we need to see if apology in such cases can work. Current procedure is a legacy of colonial era where there is no consideration of alleged person’s s social background is given or law is applied in a real centralized manner.
We also need to see what is meant by Blasphemy? I have seen muslims being persecuted for this law just because of them having a different point of view on 12 Rabiulawwal and Waseela issue.
We neither want a Pastor Terry Jones type situation which can start a civil war in the country nor we should make it a holocaust issue on which even debate is not allowed in many countries including those who call themselves civilized.
The problem is that we are in a war mode and stuck in an unwanted war which has destroyed or social fabric and everyone is in hyper state to protect their ways and level of sanity has gone down. The policy of using sectarianism as a tool by establishment and foreign masters for expanding war has also contributed in this.
If we claim to be muslims and call our state an Islamic state then basic principles of justice and equality which were part of the first Islamic state of Madina and also part of Meesaq e Madina should be kept in mind.
After the WikiLeaks deluge

ISLAMABAD: Pakistan stands insecure as our leadership, both political and military, ruling the country have been exposed by no one else but Washington, to whom our leadership is shown by WikiLeaks to have sold their souls at the cost of national integrity, honour and prestige.
Is our fate in safe hands? This is the fundamental questionthat boggles almost every mind in Pakistan as the WikiLeaks bombshell, believed to be deliberately leaked by Washington to attain its designs including chaos in Pakistan, leaves hardly anyone among the leaders here to be trusted.
Each and every word of WikiLeaks would be taken as true if Pakistani authorities and leaders, blamed and shamed by these leaks, do not come out with a clear answer. They need to reply, more importantly through their actions, that Pakistan is no more American domain.
Otherwise, WikiLeaks precisely proves what was earlier said i.e. Pakistan has been practically reduced from a sovereign state to an American colony as the president, prime minister, top political leaders and even Army chief all have been shown pleasing or taking into confidence the US ambassador — the de facto viceroy of Pakistan — to continue ruling the roost with the blessings of Washington.
DG ISI Lt Gen Pasha too crossed the limits of discipline as he is shown by the WikiLeaks to have told US officials that President Asif Ali Zardari was corrupt. The question here arises why did he report such purely internal matter to the Americans.
The only exception has been Imran Khan, the man who on the face of Americans has been criticising US policies, drone attacks, the so-called war on terror besides asking for negotiated settlement with Taliban to end extremism and refusing to dance to the tunes of the “real masters” of this unfortunate country.
Shame is too little a word to reflect on the portrayed conduct of those ruling Pakistan after one goes through the WikiLeaks, which is expected to heap more dirt on Pakistan as well as the Muslim nations.
What would be more shameful than reading President Asif Ali Zardari as conceding to the Americans, “We are here because of you,” and then assuring Washington, “We won’t act without consulting with you.” To the pleasure of his masters, Zardari committed Pakistan to the war on terror, insisting that it was Pakistan’s own war.
Asfandyar Wali too shares the shame by inviting Washington to influence both Nawaz Sharif and Asif Ali Zardari through Jeddah and Dubai to mend fences. Why did he invite three foreign countries in matters purely pertaining to internal politics?
Look at the callousness of Prime Minister Yousuf Raza Gilani, who on the issue of drone attacks told Washington, “I don’t care if they (US) do it (carry out drone attacks) as long as they get the right people. We’ll protest in the National Assembly and then ignore it.” The premier had snubbed the interior minister Rehman Malik, who had suggested to the Americans that the Predator attacks should be stopped after the Bajaur operation.
Look at the double speak of the PML-N, whose top leadership both Nawaz Sharif and Chaudhry Nisar Ali Khan were shown repeatedly assuring the Americans that the PML-N was pro-America. To leave no doubt about his loyalty to the Americans, Nawaz recounted his decision to override his Chief of Army Staff and deploy Pakistani troops to Saudi Arabia in support of the US coalition in the first Gulf War. Here Chaudhry Nisar Khan reminded that it was the PPP and its leaders who were organising street demonstrations against Pakistan joining with the US coalition.
Exposing the hypocrisy of the already stinking Maulana Fazlur Rehman, the WikiLeaks revealed that the leader of the country’s most fiercely pro-Taliban religious party, hosted a jovial dinner for Ms Patterson at which the Maulana sought her backing to become the prime minister and expressed a desire to visit America. His lieutenant Abdul Ghafoor Haideri acknowledged that “All important parties in Pakistan had to get the approval of the US (to get power).” Just compare the actions of these Maulanas to what they preach in their speeches. Simply disgraceful!
Interior minister Rehman Malik is referred to as a frequent and co-operative interlocutor, who professes his support for cooperation with the United States.
No less shocking is the way the Army Chief General Ashfaq Parvez Kayani has been opening his heart and mind before the Americans, including the US ambassador. Otherwise giving the impression of being a man of few words, the Army chief spoke before the Americans against President Zardari and opposition leader Nawaz Sharif, and also talked of getting resignation from the president and tailoring democracy to his sweet choice.
He also hinted at supporting Asfandyar Wali Khan, the leader of the Awami National Party, as the new president. Kayani even made it clear to Ms Patterson, the former US ambassador, that regardless of how much he disliked Zardari, he distrusted Nawaz even more.
Such hobnobbing of the military chief with any foreign diplomat or official, what to talk of Americans, is undoubtedly a violation of discipline and breach of his oath. Unluckily, we have a tainted president, tainted prime minister and tainted political leaders otherwise this is a fit case of seeking explanation from the Army chief.
With such leadership, both political and military, Pakistan’s future is really bleak. Whom should we trust? Who is free from the US influence? Can we become a sovereign nation? Can we take our own decisions? Why do we have more faith in Washington than in God? How could we save Pakistan from being destabilised after reading what our president, prime minister, political leaders and Army chief have said to a minnow American — Anne Patterson? With such leadership, how can we tackle the problem of terrorism? Who would save us from disgrace and shame?
One hardly has any answer to the above questions. Our irony is that our leaders are leading us to shame like never before. What option do they have to undo what they have brought for this country and its people? Resignations and stepping down from their respective public and political offices is one option. Another option is to say a firm no to the American drone attacks, cut the Nato supply line, revisit our policy on US’s so-called war on terror, halt all military operations inside Pakistan, open up dialogue with the local Taliban leaders to bring to an end terrorism and desist from dancing to the tunes of Americans.
Otherwise these leaks, containing truths and half-truths all suiting Washington but embarrassing others, are bound to create more mistrust and chaos in the country, which is the actual design of those having leaked it from Washington.
Issue of power sharing between center and different units of federation has always been a topic of great importance in Pakistan. In a country, which was founded on the basis of a common ideology of Islam but itself is consisted of a diversified demography, adapting a centralized common system becomes a very tricky question.
The diversity in our society is not only in terms of culture, linguistics, races, life style and living standards but if we look at religion, diversity is their to a large extent despite us being an Islamic State and vast majority is Muslim. Not only religious diversity is there in the form of different religious minorities but within the majority Muslim population presence of different sects with range of conflicting issues have created many problems in terms of legislation and implementation of law.
Distribution of resources and authority to run their affairs has also seen its share of conflicts in our country. The biggest example is the fall of Dhaka when more than half of our population felt that their rights are not been given by the authorities controlling the center. Even after the fall of Dhaka smaller provinces have felt the similar feelings. This issue of provincial autonomy has always played an important part in the electoral politics of the country. Even if we see the current parliament, we can clearly see the strong provincial and ethnic color of our political base.
The history of our country shows that these demographic diversity and provincial autonomy issues are not tackled well by our mainly centralized system. Whether we see feudal-corporatist democratic periods or military dictatorships, the tensions between different communities and regions have increased over the time. This situation indicates us of adapting a different approach of running our affairs related to governance, legislation and economy which will not only cater the problems mentioned above but ensure a sustainable progressive path for our future. This type of system will require the loosening of grip by centralized power structure over our national affairs, in other words we need a decentralized governance, legislative and economic structure.
Decentralization of governance means a state gives majority of authority and control to the lower levels of administration for e.g. provinces and local bodies. In this the decision making process will be in a bottom-up model i.e. decisions are taken at the local and gradually passed on to the center and in most cases passing on to the center is not required. This type of governance model will ensure that governance decisions and structuring of institutions is done according to the needs of local requirements for e.g. policing system of Karachi may not work well in FATA and Dera-Bugti.
If we see in past several steps have been taken like setting up local bodies, establishing alternate policing structure in the form of FC or giving some departments to the provinces. But the main problems was and still is the upper hand of central government and flow of resources from center to the federation constituents. The big size of the government also plays a negative role in implementing decentralization of governance as we see several ministries and departments work where there is no requirement of government at all.
The other thing which we need to do is to decentralize the process of legislation. Even thought we are a dominant Muslim state but still our customs and cultures vary from area to area in our country. Also the presence of different religions, sects and social communities demands for a legislative system flexible and capable enough to cater the needs of regional and social diversity. This can be achieved by keeping the centralized common laws as minimum and delegate the legislative powers to regions and social communities. By giving legislative powers to social communities means law making related to a particular social community should be done by the representatives of those communities. Careful provisioning can be done to ensure basic human rights and conflicts of interest.
Now the issue will come of handling the situation where different people from different social and religious backgrounds are involved in a dispute. This can be done through social contracts between communities like “Meesaq e Madina”, empowering civil courts to resolve disputes based on social customs and some careful central legislation just to resolve disputes between different social communities can be made.
After governance and legislation, we see how we can run our economic affairs more efficiently and transparently. It is again an issue of great discussion in Pakistan whether the state should control the economy and run the institutions like steel mills, PIA itself or not. But if we look our history more than having the issue of it should or should not, the issue is the capability of the state of doing it. We have seen huge corruption scandals involving key government and establishment personalities being highlighted in media and taken up by courts. Most of the time the main reason behind other than greed is having too much discretionary powers. If we see many of these powers are a result of unnecessary state involvement and undesired regulations. All these not only lead to corruption but also result in economic loss as a result of inefficiencies created.
Therefore regulation, in areas other than where it is required to cater corruption and social benefits, should be removed and free market economy is needed to be promoted. The discretionary powers of licensing and quotas needed to be eliminated so that fair play can take place and more economic opportunities are created. Privatization is also a key element of decentralization of economy but it needs to be fair and transparent otherwise it will be counter productive and will result in more economic instability.
The two key steps we need to do to achieve decentralization and reap its benefits are strengthening the judiciary and to reduce the size of state. Strengthening judiciary is necessary in order to ensure smooth running of affairs between different federal constituents and social communities. In absence of a strong, independent and impartial judiciary we cannot expect any smooth running and harmony among different constituents of our country. Luckily through recent lawyers movement we have at least come to the point where a big portion of our society has realized the importance of having a strong and effective judicial system. The other thing which we need and as discussed above is reducing the size of our government. This is necessary to create more economic opportunities and more freedom.
If we look at the 18th amendment, the situation is not that promising. On one hand if they have dissolved the concurrent list, the parliament on the other hand has strengthened an unelected party head who will be in actual the ruling authority whether in center or in provinces. The biggest thing which happened in 18th amendment is weakening the judiciary and making them dependent on parliamentarians by forming judicial commissions and parliamentary review committee. This will not only pave way for corruption and lack of accountability but it will also endanger the rights of people not represented by the elected parliamentarians or not represented by the government as judiciary is supposed to be an institution safe guarding the basic human rights of all people including those who didn’t vote for the government or don’t give votes at all.
If we look at our history main challenge we face towards achieving decentralization is political will not the lack of capacity and resources. Our national politics is mainly dominated by our military establishment and feudal-corporatist political class who are mainly interested in having the tight grip over the country affairs, economic resources and political decision making. This totalitarian approach has given us nothing except for miseries and sense of deprivation and hopelessness for our people.
Even though slogans like provincial autonomy, provincial harmony, devolution of power have played key roles in country politics but not much in true sense has come out. Its high time for us to re-think our strategy as a nation and decide how we should proceed towards our future course in time. Decentralization is not only necessary for efficient and smooth running of our affairs but it will give more freedom, confidence and sense of ownership to our people.

In a country where people are not able to find sugar and other daily usage items and where electricity has become a real luxury , the elite political , military ,corrupt business and bureaucratic classes consider themselves above every law of the land and don’t think of themselves answerable to any system of justice.

ISLAMABAD: The National Accountability Bureau (NAB) presented to the government on Thursday a list of 248 politicians and bureaucrats, who were alleged to have plundered hundreds of billions of rupees but were cleared by the NAB under the NRO.
Sources in the Law Ministry while sharing with The News the “complete list” of NAB’s NRO beneficiaries, explained that thousands other cases of NRO beneficiaries did not belong to the NAB but with the provincial governments because they were criminal cases and were not covered by the NAB law.
On top of the list is the name of President Asif Ali Zardari while his several close associates, both political and bureaucratic, including Rehman Malik, Salman Farooqi and his brother Usman Farooqi, Hussain Haqqani and Siraj Shamsuddin are also reflected.
The list, which also reflects a brief introduction of the cases dropped against each name under the NRO, also includes the name of serving and former ministers, federal and provincial secretaries, ex-chief secretaries, existing or former members of the national and provincial assemblies and others.
According to the list, Asif Ali Zardari remained the beneficiary No 1 of the NRO as at least eight of his NAB cases of corruption and misuse of authorities were dropped. These cases included the alleged kickbacks from SGS PSI Company, grant of licence to ARY Gold causing huge loss to government, corruption in purchase of Ursus tractors under the Awami Tractor Scheme, illegal award of contract to Cotecna for pre-shipment, assets beyond means, received kickbacks from Sajjad Ahmad (late) ex-chairman Pakistan Steel Mills, illegal construction of Polo ground at PM House and the money laundering SGS Swiss case.
Others amongst politicians include Nawaz Yousaf Talpur, ex-MNA and former minister, who was co-accused in URSUS tractors case; Ms Nusrat Bhutto, assets case; ex-MNA and the PPP Secretary General Jehangir Badr, assets case and corruption in Sui Southern Gas Company; ex-minister for commerce and presently Defence Minister Ahmad Mukhtar, misuse of authority in issuing sugar export permit to non-entitled persons in 1994; ex-MNA Malik Mushtaq Ahmed Awan, embezzlement in Octroi contracts; ex-MNA Rana Nazir Ahmed, assets case and misuse of authority; ex-MPA Mian M Rashid, assets case and illegal appointments; ex-MPA Tariq Anees, assets beyond means; ex-MPA Mian Tariq Mehmood Dina, assets beyond means; ex-minister of education Sindh Agha Sirajuddin and others, misuse of authority; ex-chief minister and former interior minister Aftab Ahmed Sherpao, misuse of authority, illegal allotment of plots and assets case; ex-provincial minister Ghani-ur-Rehman, assets beyond means; ex-senator Haji Gulsher, misuse of authority and acquisition of land; ex-provincial minister Habibullah Khan Kundi, misuse of authority and acquisition of land; ex-MNA Mir Baz Muhammad Khan Khethran, misappropriation of government funds allocated for people’s works programme; ex-federal minister Anwar Saifullah Khan, misuse of authority in allocation of LPG and illegal appointments; ex-provincial minister Sardar Mansoor Laghari, corruption in Utility Stores Corporation; ex-Mayor Sargodha Ch Abdul Hameed, assets beyond means; ex-chairman Zila Council Lahore Ch Shoukat Ali, ex-MNA Haji Kabir and ex-chairman Zila Council Lahore Ch Zulfikar Ali in Zila Council fraud case.
