LAHORE, May 18: Supreme Court Bar Association (SCBA) president Aitzaz Ahsan has pulled out of the electoral race to save the Pakistan People’s Party from an embarrassing situation because at around the time of the coming by-election he will be leading the lawyers’ long march and movement for reinstatement of the deposed judges.

Addressing a press conference here on Sunday, Mr Ahsan said he had informed Pakistan People’s Party co-chairman Asif Ali Zardari on Saturday that he was withdrawing his application for the PPP ticket for the by-election.

The SCBA chief said he wanted to concentrate on making the long march a success.

He said the long march would be a decisive factor in the struggle launched by the lawyers 14 months ago and it needed his full-time devotion.

The SCBA president announced that the long march would begin from Multan on June 10.

After attending gatherings of Sahiwal and Okara bars, the caravan of judges and lawyers will move to Lahore. The next day it would proceed to Islamabad via Gujranwala, Gujrat and Jhelum, he said, adding that the same day another caravan of lawyers would converge on Islamabad from Peshawar.

“The lawyers will go to parliament which is at the centre of the current controversy.”

A lawyers’ meeting held here on Saturday had expressed confidence in the leadership of Mr Ahsan and left the decision about taking part in the by-election to him.“Since all arrangements for the long march are to be made and contesting the by-election may also put the PPP in an awkward position, it is better to withdraw from the electoral race and concentrate on the lawyers’ movement,” he said.

He said that people must translate their love for deposed Chief justice Iftikhar Mohammad Chaudhry into action.

Mr Ahsan appealed to all ‘conscious segments’ of the society, including students, traders, members of the civil society, political workers, professionals and the media, to join the struggle for independent judiciary. It was the “only way to safeguard the future of the nation,” he insisted.

He said the presidency was continuing to hatch conspiracies against democracy and one proof of this was that the attorney-general had not been changed.

Mr Ahsan said the lawyers would call off the long march if the judges were reinstated before June 10.

In reply to a question, he said the decisions of the Supreme Court presided over by Justice Abdul Hameed Dogar could be covered under the ‘de facto doctrine’ after the reinstatement of the deposed judges. He said he did not know whether the deposed judges would take up the National Reconciliation Ordinance (NRO) after their reinstatement.

Mr Ahsan conceded that he had differences with the PPP co-chairman on the issue of the judiciary but refused to provide details.

When asked if the lawyers intended to picket the General Headquarters or parliament at the end of their long march, Mr Ahsan said the army did not have any role in the current crisis and the lawyers were convinced about the neutrality of Chief of Army Staff Gen Ashfaq Kayani.

The date decided with the mutual consensus is 10 th of June 2008 and according to SCBA president Aitzaz Ahsan the Chief Guest for the March will be the honorable genuine CJP Iftikhar Muhammad Chaudhary.

Lawyers have formed a committee to decide the future coarse of the movement.

APDM to Meet on 18 May

APDM will hold a meeting on 18 May in Islamabad to decide the future line of action for the movement to restore judiciary in Pakistan.

“Experts from all segments of the society would be invited to the conference. They would take into account the current situation and express their views to chalk out the future line of action,” sources in APDM told The News here on Friday.

The sources further said the committee, which included Liaquat Baloch, Akram Shah,

Dr Hameed Memon and Sardar Zaheer, would hold a session to decide a date for the conference, prepare the draft of invitation and alsofinalise the names of those

who were to be invited to the forum.

Supreme Court Bar Association President Aitzaz Ahsan has categorically rejected the idea of two Supreme Courts when asked the the opinion on the issue by Talat Hussain of AAj TV in the programme Live with Talat.

He said the suggestion refers to an arrangement which is Dogar and Iftikhar Chaudhary specific and he said it will be like spliting the court in two parts.

In his interview he also said that he tried his best to convince his party leadership and accepted that his opinion is considered as and opposing one in the party circles and he blamed the leagal advisors of the party for this.

Aitzaz Ahsan who is also a member of central executive committee of PPP said he and Justice(R) Fakhruddin G Ebrahim sent their arguements in writing to the committee for the restoration of judiciary in which they gave a solution for the PCO judges adjustment as appointments on ad-hoc bases which will not only keep the PCO judges in the court but also will not disturb the seniority of the genuine judges.

He also again rejected the minus one formula and revealed that he was given this proposal by a very trusted advisor of Musharraf when he was in Adiala jail during emergency(Martial Law).

Two Supreme Courts being considered to resolve judges issue

ISLAMABAD: Two parallel Supreme Courts are being quietly discussed in Pakistan as part of a draft constitutional package to resolve the complex issue of the deposed judges’ restoration.

The proposal envisages one Supreme Court to be headed by the deposed chief justice Iftikhar Muhammad Chaudhry dealing only with criminal and civil cases and the other by the incumbent Chief Justice Abdul Hameed Dogar, which would be looking after the constitutional matters. It will also have all the suo motu powers.

Highly-placed sources close to the presidential camp revealed that the new constitutional court to be headed by Justice Dogar, whom Musharraf and Asif Zardari do not want to lose, would be named as the Federal Constitutional Court (FCC), which would be exclusively empowered to deal with all the constitutional issues, such as the interpretation of the Constitution, the National Reconciliation Ordinance (NRO), constitutional controversies, the validity of President Musharraf and most importantly the suo motu actions.

Sources said the court, to be headed by Iftikhar Chaudhry, would be a sort of an appellate court on the high courts of the four provinces. But the court headed by Justice Dogar would handle the real issues that worry the presidency and the Zardari House.

Likewise, the new constitutional package also envisages the formation of a parliamentary committee to scrutinise the judges as it was envisaged in the Charter of Democracy.

This correspondent made several calls to Law Minister Farooq H Naek to get his point of view but he did not pick up his mobile phone. He did not even answer an SMS sent to him. Several calls were also made to a member of the constitutional committee Raza Rabbani and Aitzaz Ahsan but they too could not be reached.

The new proposal contemplates the creation of a Federal Constitution Court, to be headed by Justice Dogar with seven judges on the bench. A separate Supreme Court of Pakistan to deal with civil and criminal appeals would be headed by Iftikhar Chaudhry.

This court will consist of the deposed colleagues along with some of the PCO judges. Sources claimed that if approved and enacted by parliament, the existing structure of the superior judiciary would be altogether changed into two distinct entities.

An important impact of this proposed amendment over the life of common citizen would be withering away of the writ jurisdiction, as provided under Article 199 of the Constitution, and all five writs shall be exclusively entertainable by the federal Constitution alone.

The status of both the courts with perks and privilege of the judges shall be at par and judges from one court to another court shall be transferable through exercise of executive authority. The proposed arrangements being discussed further envisages that the Federal Constitutional Court would be the only competent forum to issue writ of the nature of mandamus, certiorari, prohibition, declaration and injunctions and shall be competent to adjudicate upon disputes arising between the Federation and the federating units and shall be vested with the jurisdiction to interpret ambiguities in constitutional provisions and shall be competent to issue injunctions, both interim and perpetual and could validate or declare as null and void a constitutional provision or a subordinate law.

One expert said the proposed draft, if examined on the touchstone of the jurisdictional and judicial powers of the present day Supreme Court enshrined in the Constitution of Pakistan, shall be tantamount to divide the powers of the apex court into two entities.

The Supreme Court, headed by Iftikhar Mohammad Chaudhry, shall be reduced to the level of a civil court of civil and criminal appeals whereas all matters of public and the national importance, including those warranting interpretation of status, laws and constitutional provisions shall be vested in the Federal Constitutional Court and by such way, any disputes relating to the legitimacy of an incumbent of a government office like president, governor, etc, shall be exclusively litigated before the Federal Constitutional Court.

The expert said the move appears to placate the apprehensions of the establishment and the presidency on the one hand and endeavour to appease the civil society, media and the lawyers on the other.

Not only that the question of validity of President Musharraf shall remain buried, but also to pre-empt the ambitious pursuit of Justice Iftikhar Chaudhry of frequent exercise of powers of the judicial review, a need for creation of a Federal Constitutional Court was felt and a resolution likely to be tabled next week in parliament shall be qualified with the passage of the constitutional package.

The expert said if this draft law was enacted, the institution of the judiciary would be belittled with its powers divided and jurisdiction curtailed. The immediate and most lethal impact of the constitutional package would be ordinary litigants and general citizens of the society with the withering away of the writ jurisdiction of the high court and in the absence of the alternate remedy at provincial capitals and where the high court benches are functioning. A great deal of inconvenience would be involved to present petitions to the Federal Constitutional Court at Islamabad.

The expert claimed that even the deposed judges would prefer to stay away from the chambers of the newly-styled Supreme Court and the lawyers community was expected to put an en bloc opposition to the move.

The expert feared as the package was likely to affect the life of an ordinary citizen, the response from the public may aggravate the situation and if the move failed on the floor of the house, either for dissent by the PML-N or for any other reason, the fate of the coalition government in Islamabad would also be decided there and then.

Earlier, Rehman Malik was taken aback when he was given extraordinary protocol at the Islamabad airport. He found dozens of top security and protocol officers receiving him inside the plane. A bulletproof car was specially parked close to the plane and he was taken out of the Islamabad airport amid tight security, which is not even available to the federal ministers.”  [2]

 

What was this secret meeting all about? Why was he flown to meet Ejaz Shah who was one of the possible killers of Benazir as said by her? Why was Ejaz Shah present at this meeting to discuss security of Benazir when he was being alleged to be behind Oct 18 attack on Benazir? Rehman Malik did not respond to journalists when they came to know about the meeting and asked for his opinion:

 

“Talking to The News, Rehman Malik confirmed his meeting with DG ISI, but refused to comment on the nature of his talks. On the issue of extraordinary security provided to him by the government, Malik said, they had some concerns about my security and they acted on their own.”

- Brigadier Cheema officially told on TV that BB was safe after confirming from CSO RM, who himself said the same on Geo TV

- As the tire of BB’s car got burst after the explosion, Major Imtiaz moved BB to Shery’s car after traveling a short distance

- RM went directly to Bilawal House in Islamabad and confined himself there until Zardari reached Islamabad from Dubai

- Babar Awan sitting next to RM says that they directly went to Bilawal House in Islamabad assuming that BB was okay and she was directly following their car.

- Once Babar found that BB did not reach Islamabad, Babar immediately rushed back towards Rawalpindi and RM did not accompany him to Rawalpindi.

- Babar’s statement (who was sitting next to RM) is in complete contradiction to RM’s claim that:

—> They returned to hospital from next U-Turn (as told to Iftikhar of Geo)
—> They stopped the car when they could not see lights of BB’s car anymore

Last but not least, the suspicious person with strange antics standing close to BB while she was addressing at Liaqat Baagh, was hired on special recommendation of Rehman Malik. This person, Khalid Shahinshah who was personal servant of BB, might have known about the explosion in the advance which could be the reason he rushed into the armored car before everyone else.

PPP sources have reported that the moment Benazir ended her address, this (servant) man was the first one to dive into her bullet proof Land Cruiser; an unusual change from past routine whilst he always boarded the vehicle after Benazir, often hanging by the external pedestals of her Cruiser, as was evident in videos.

One other household servant and Dr Safdar Abbassi got seated in the rear portion of the Cruiser, and when the suicide bomber blew himself apart, Khalid was also present in the Cruiser. Afterwards he (Khalid) went over to the Zardari House, Islamabad where he lived for two days, and did not visit Naudero despite Benazir’s death, making it there on third day. When informed about the video of his antics he promptly disappeared from the scene, over the excuse of his mother’s death.

ISLAMABAD: The controversy behind the postponement of the by-elections deepened on Wednesday when the Election Commission Secretary Kanwar Dilshad revealed that he had received a phone call from Adviser to the Prime Minister on Interior Rehman Malik, who had asked for a delay. This confirms a similar claim by the NWFP government. As Dilshad’s statement to The News firmly established that Rehman Malik was the man who had successfully executed the controversial postponement, it was still unclear who, between the Zardari House and the presidency, actually authored the script of the so-called conspiracy.

Dear Mr Asif Ali Zardari,

THE election result was an answer to the prayers of the nation. However, the forces of evil forces have been bending over backwards trying to sabotage the democratic process and incite the lawyers into entering into a confrontation with the new government.

They need to be told that we are not the gullible sheep of the past. I am a born optimist, and while writing this, a part of me tells me not to be silly. I want to believe that the Bhurban accord will be honoured and that the tenure will be as it was on Nov 2.

The nation is absolutely not prepared to consider such a humiliating option. It is humiliating for the deposed judges, who for the sake of this ravaged country, put their families at risk. You must have experienced that fear too when Shaheed Mohtarma Benazir Bhutto returned to Pakistan last October.

It will be an insult to her memory because she risked her life for democracy, and she, above all, knew what an independent judge meant.

It is trivialising the sacrifices of the lawyers, who, despite all odds, have stood their ground for over a year. The world has already accepted Justice Iftikhar Chaudhry and the 60 honourable judges as icons of the struggle for an independent judiciary. Theirs and the names of thousands of brave lawyers have already gone down in history for all times.

A compromised restoration will be an insult to the memory of Hammad Raza, the first precious life lost after March 9, 2007. What about the massacre on May 12, the carnage the day Benazir landed in Karachi, the brutality unleashed on lawyers and civil society, the inhuman act of burning lawyers alive in Karachi? It will be insulting the memory of Shaheed Mohtarma Benazir Bhutto, whose mission was to restore democracy, and who better than her knew the value of an independent judge. The nation lost a great leader on that tragic day.

Too much water has flowed under the bridge, and it is unthinkable that after getting this far, there can be talk about actually penalising the judges. Because that’s exactly what this act would be.

Mr Zardari, I am fully aware of your sufferings, the brutal act of cutting your tongue, your long years in prison, and the fact that you did not have a pleasant experience with the judiciary at the time. We condemned it then and we condemn it now. But, sir, it was a different Pakistan then, which I say with regret. As I said earlier, we were a nation of sheep. Why am I not writing to President Musharraf? Because one pleads before someone who you have faith will relate to you — and that’s the beauty of democracy.

My late father, Justice Safdar Shah, was a victim of an amendment in the Constitution by Mr Z.A. Bhutto when he was chief justice of the Peshawar High Court, identical to the one I am writing about. An ideal person to be appointed judge of the Supreme Court by Gen Zia and to be party to the judicial murder of the very same man. Fortunately, he refused to sell his soul, and the rest is history. At least today I can hold my head up high.

Many other honourable judges have stood up for the independence of the judiciary in the past, but they were not supported the way these judges were.

The nation has suffered long enough. The president has ravaged the country for nine years and wants five more. Yet time is being wasted on whether the deposed judges (real for me) should have their wings clipped. The president uses words such as ‘scum of the earth’ for a man whom the world has honoured, and gets away with it. We are stuck with an attorney-general whose father was party to the judicial murder of Mr Bhutto. Certain ministers are visiting the man who wrote in his book that the worst thing that happened to this country was Zulfikar Ali Bhutto.

Why is there intrigue and jealousy against the likes of Aitzaz Ahsan? Should we forget how Muneer Malik was tortured? Men of principle like Ali Ahmad Kurd, Justice Tariq Mehmood and so many others who led this movement are a rare commodity. Why are people like Sharifuddin Pirzada and Maulvi Iqbal Haider allowed to assist the Supreme Court in mutilating the Constitution?

Yet priceless assets like the honourable Justices Wajihuddin and Fakhruddin G. Ebrahim are ignored. Mr Zardari, I recall clearly the conversation between late Mohtarma Benazir Bhutto and my late father just before she returned to Pakistan in 1986. Amongst other things, he repeatedly told her not to surround herself with sycophants, and that Mr Bhutto’s fate was because of such elements.

Mr Zardari, do you realise the importance of the opportunity God has given you? In the past we have had independent judges but never an independent judiciary.

The hearts of the nation are with you in the torment you must feel for your children since the loss of their mother. You can either prove yourself to be a selfless, pragmatic leader, rising above personal grudges, or you can go down in history as the man who deprived this nation of an opportunity that can come only once in a lifetime.

Sir, I have confidence that inshallah you will do the right thing, and that you will put the wishes of the people and the salvation of Pakistan first.
